This is a translation. In case of any discrepancy, the Spanish version prevails.
1. Applicable legal regulation
1.1 The terms and conditions set forth in this document are mandatory and binding. They apply to all reservations and activities made through our website, by email, by WhatsApp, and any other official digital means used by WANDERNOW SA DE CV. The use of any of these channels and/or services implies the KNOWLEDGE and ACCEPTANCE thereof by the “client”.
2. Modifications to the terms of use
2.1 WANDERNOW SA DE CV reserves the right to make modifications or updates to our terms at any time. It is the responsibility of clients to review them.
3. The parties
3.1 The following shall be considered the “Organizer”: WANDERNOW SA DE CV, with its fiscal address at Otilio Montaño #13-8, Col. Corral del Risco, Punta de Mita, Nayarit, México, RFC WAN190107190, as well as those local operators (third parties) that provide services to it.
3.2 As “Traveler/Client”, any person interested in acquiring and/or contracting the services offered by WANDERNOW S.A de C.V, on any of its platforms and/or digital channels.
4. Terms for reservations
4.1 Registration for any of the adventure trips offered and operated by WANDERNOW SA DE CV shall be formalized upon payment of the amount specified in the “BOOK ADVENTURE” section. This amount may vary among the adventure trips offered by WANDERNOW S.A de C.V, depending on the content and program offered in each of them.
4.2 Said payment will be processed in the currency of the adventure trip's quotation (USD or EUR, as applicable), through the official payment platform indicated on the WANDERNOW SA DE CV website.
4.3 For these purposes, WANDERNOW S.A de C.V shall issue a payment RECEIPT, confirming the amount, date, destination, pending deferred payments, exchange rate (when applicable), and specific details of what your purchase INCLUDES and EXCLUDES.
4.4 WANDERNOW S.A de C.V, as an adventure trip operator, shall inform on its website the payment dates for each adventure trip, to which the client adheres when making their reservation payment.
4.5 WANDERNOW S.A de C.V undertakes to provide services in accordance with the characteristics, quality, and deadlines indicated in the PAYMENT RECEIPT. The client must at all times comply with the safety regulations that WANDERNOW S.A de C.V has or may establish for the provision of the service, as well as the instructions provided during the execution thereof.
4.6 PAYMENT METHOD: WANDERNOW S.A. de C.V. uses the WeTravel payment gateway (wetravel.com), where all payments are received directly. Available methods depend on the country from which payment is made; mostly: credit or debit card (Visa, Mastercard, American Express), Apple Pay and Google Pay, and in some countries bank transfer, all through WeTravel. Payments can be made in a single installment or in deferred payments.
4.7 In the event that payment is made in a currency other than the adventure trip's quotation currency, the conversion will be determined by the official payment platform used, without manual intervention by WANDERNOW SA DE CV.
4.8 DEFERRED PAYMENTS: Each trip is paid with a deposit upon booking and up to 10 deferred payments (Antarctica: up to 12). Payments are scheduled every 30 days counted backwards from the departure date; the final payment is due 60 calendar days before departure. The deposit amount may vary by trip and is indicated on each trip's page.
4.9 AUTOMATIC CHARGES: By choosing deferred payments, the traveler authorizes Wandernow to automatically charge each payment to the payment method registered with WeTravel on the scheduled date. WeTravel will send email reminders before each charge. It is the traveler's responsibility to keep their payment method valid and ensure sufficient funds are available.
4.10 ADDITIONAL PAYMENTS: The traveler may pay any amount they wish towards their outstanding balance at any time, in addition to scheduled payments or in advance. Each payment reduces their outstanding balance.
4.11 LATE BOOKINGS: If, at the time of booking, the date of one or more deferred payments on the trip's schedule has already passed, the traveler pays the deposit upon booking and the amounts of those overdue payments are automatically distributed among the remaining deferred payments. Therefore, the later the booking is made, the fewer payments there will be and the higher their amounts.
4.12 BOOKINGS LESS THAN 60 DAYS BEFORE DEPARTURE: Bookings made less than 60 calendar days before the departure date can only be paid in a single payment, settling the total cost of the trip at the time of booking, in accordance with point 6.10.1.
4.13 UNPAID PAYMENTS: If an automatic charge cannot be completed, the outstanding amount is added to the next scheduled payment, in accordance with point 8.1.4.
5. Modifications/changes by the organizer
5.1 The organizer, WANDERNOW SA DE CV, reserves the right to make basic changes to the itinerary and/or programmed activities, as well as places to visit, without prior notice if it deems it necessary to solve external problems such as extreme weather, road closures, and/or local political situations.
5.2 If during the adventure trip the agency is unable to offer any of the contracted services, it will attempt to find a service with similar characteristics. If the traveler continues with the solutions provided by the organizer, it will be considered that they tacitly accept said proposals.
5.3 Activities included in the adventure trip price are non-refundable under any circumstances. If due to weather, safety, or force majeure an included activity cannot be carried out on the scheduled date, Wandernow will attempt to reschedule it within the same adventure trip; if not possible, no refund will be issued.
5.4 In the event that the traveler voluntarily chooses not to participate in any activity, the company shall NOT refund any amount under any circumstances. The routes described in the programs may be altered at the guide's discretion, according to weather forecasts or other organizational or safety reasons, without prior communication to the traveler. The guide accompanying the group is responsible for the safety of all participants and their instructions must be accepted. If the traveler has any significant physical or medical problem, allergy, or food intolerance, they must indicate it to ensure appropriate action in case medical or first aid assistance is necessary.
5.5 WANDERNOW S.A de C.V cannot guarantee that hotels, means of transport, and other services included in the adventure trip are adapted for people with reduced mobility or disabilities, being exempt from any liability that may arise from non-compliance or defective fulfillment in the provision of services included in the adventure trip and that originates from this cause.
5.6 Weather conditions, infrastructure, and limited capacity in some destinations may lead to transport delays, resulting in interruptions, limitations, or itinerary changes. This could incur additional expenses for food, accommodation, and/or transport, which are not included in the program. These expenses are entirely the traveler's responsibility. The organizer cannot assume any liability, financial or otherwise, due to these changes.
6. Modifications and/or Cancellations
6.1 The client may request a change of date and/or destination for their adventure trip up to 60 calendar days before departure, by paying a penalty of 500 EUR or 500 USD (depending on the currency in which the adventure trip is quoted), plus any price difference that the new date and/or destination may generate. Changes are not accepted less than 60 calendar days before departure, as Wandernow has contracted and paid its suppliers (see 6.10.1).
6.2 The foregoing applies equally to single payment and deferred payment plans.
6.3 In the case of reservations for more than one person, the user understands that the BALANCE is individual. Therefore, it cannot be credited or transferred to any other member of the group should one or more persons be unable to attend.
6.4 Name changes or transfer of adventure trip rights are valid only with persons not already registered in a reservation or adventure trip.
6.5 If, due to reasons of force majeure beyond Wandernow's control (armed conflicts, natural disasters, volcanic eruptions, airport or border closures, health emergencies, political situations, or similar), an adventure trip cannot be carried out, Wandernow will reschedule it to the earliest possible date. If the traveler does not accept the new date, Wandernow will negotiate with its suppliers (airlines, hotels, transport, and others) for the rescheduling, credit, or refund of services already contracted, and the traveler will receive a credit valid for 12 months for any Wandernow adventure trip for the total amount paid, minus only the costs already paid to suppliers that could not be recovered, of which Wandernow will provide a detailed breakdown. Travelers residing in Spain or another European Union country may refuse the credit and request a refund of the total amount paid, which will be processed within 14 days in accordance with European package travel regulations.
6.6 WANDERNOW S.A de C.V reserves the right to condition the realization of any of its adventure trips on a MINIMUM NUMBER OF TRAVELERS (6 registered). Wandernow will confirm if the adventure trip will take place no later than 90 calendar days before the departure date. This applies to any domestic or international adventure trip. Should the required minimum number of clients not be met, WANDERNOW S.A de C.V reserves the right to CANCEL, offering the client the option to reschedule to a new date or destination.
6.7 If the adventure trip is cancelled due to not meeting the minimum number of travelers (6.6) and the traveler does not accept rescheduling, 100% of the amounts paid up to that moment, including the down payment, will be converted into a credit in their favor, valid for 12 months for any Wandernow adventure trip, without any right to claim compensation. This also applies if the traveler had not finished paying for their adventure trip. Travelers residing in Spain or another European Union country may refuse the credit and request a refund of the amount paid, which will be processed within 14 days in accordance with European package travel regulations.
6.8 Wandernow does not issue cash refunds or refunds to the original payment method. When compensation is due to the traveler under these terms, it will only be granted as credit for another Wandernow adventure trip. The sole exceptions are those provided in sections 6.5 and 6.7 for travelers residing in Spain or the European Union, and in section 8.2 for extra activities.
6.9 Failing that, the client will have the possibility to change the date and/or destination of their adventure trip, considering potential price increases or reductions for the chosen adventure trips.
6.10 Timely payment confirms the adventure trip. By making a purchase, the traveler accepts these terms and conditions, including the deadlines in this section.
6.10.1 The adventure trip must be fully paid no later than 60 calendar days before the departure date. From that moment, Wandernow contracts and pays its suppliers only for travelers who have made full payment. Any traveler who has not paid in full by this deadline will be excluded from the adventure trip without right to refund, in accordance with section 8.1.2.
6.10.2 The traveler must upload their complete documentation to the “My Account” section of wandernow.com (valid passport, arrival and departure flights, medical expense insurance or waiver, visa or entry authorization when required by their nationality, emergency contact, and health data) no later than 30 calendar days before departure. Failure to do so will result in the traveler bearing any additional costs arising from last-minute changes or issuances, and services that a supplier cannot issue without this data will be lost without refund.
6.10.3 Once the adventure trip is paid in full, the traveler will receive access to the Wandernow application for their arrival registration 15 calendar days before departure.
6.10.4 Failure to appear at the agreed point and time will result in the total loss of the amount paid, without right to refund.
7. Liability
7.1 The organizer states that it assumes the functions of organizing and executing the adventure trip.
7.2 Said liability shall cease if any of the following circumstances occur: that the defects observed in the execution of the contract are attributable to the traveler; that such defects are attributable to a third party unrelated to the provision of the services stipulated in the contract and are unforeseeable or insurmountable; that the aforementioned defects are due to reasons of force majeure, understood as circumstances beyond the control of the invoking party, abnormal and unforeseeable whose consequences could not have been avoided, despite having acted with due diligence; or that the defects are due to an event that the organizer, despite having exercised all necessary diligence, could not foresee or overcome, and there is sufficient cause.
7.3 The PDF presentations sent when providing information to clients shall be for informational purposes only; what is included in the adventure trip shall be what is included in the official adventure trip receipt issued at the time of payment by the client, in which the company WANDERNOW S.A DE C.V reserves the right to include the exact number of nights issued therein, with the "USER" accepting that the location may change without prior notice based on the itinerary, considered an adventure itinerary.
8. Cancellations/Modifications by the Traveler and/or Cancellation of the Adventure Trip
8.1 Any down payment or reservation made to book an adventure trip is non-refundable under any circumstances, as it represents the Company's initial commitment to the adventure trip suppliers (hotels, transport, guides, and other services).
8.1.1 In case of cancellation by the "traveler" 90 days or more prior to the adventure trip departure date, the amount paid (discounting the non-refundable down payment indicated in 8.1) may be converted into a credit in favor of the "traveler," valid for use on another Wandernow adventure trip within a 12-month period. No cash refunds or refunds to the original payment method will be issued.
8.1.2 In case of cancellation by the "traveler" less than 90 days prior to the adventure trip departure date, no refund or conversion to credit of any amount will be made, given that from this point onwards the Company has committed to the entirety of the corresponding expenses with its suppliers.
8.1.3 The foregoing applies regardless of the reason for cancellation.
8.1.4 If a deferred payment is not covered by its due date, the outstanding amount will be added to the next scheduled payment. If the traveler accumulates two overdue payments without covering them, Wandernow will notify them via WhatsApp and email, and they will have 30 calendar days from that notification to regularize their payments or contact Wandernow. Failure to do so within this period will result in the loss of their place on the adventure trip and all amounts paid, without entitlement to a refund or credit. Any subsequent request will be reviewed as a particular case, and their eventual reincorporation, on the same or another date, may incur additional costs. In all cases, the settlement period specified in point 6.10.1 applies.
8.2 Extra activities are those that the traveler adds after paying for their adventure trip and pays for in cash during the trip. If an extra activity is canceled and the provider refunds Wandernow, Wandernow will refund the traveler the same amount it receives from the provider. If the provider does not refund, there will be no reimbursement. If the traveler does not show up for an extra activity or withdraws from it, there will be no refund.
8.3 Wandernow recommends that all its travelers purchase travel insurance with cancellation coverage, which protects them in case of having to cancel due to illness, accident, or other personal reasons. Cancellations by the traveler are governed by points 8.1 to 8.1.4, regardless of whether or not they have such insurance.
9. Adventure Trip Offerings
9.1 WANDERNOW S.A. DE C.V. reserves the right to modify the adventure trip price, content, and itinerary at any time, as a result of changes in operational costs, port and airport tourist taxes or surcharges, as well as applicable exchange rates.
9.2 The adventure trip price includes everything specified in the “What's included?” section located on our website. At the time of booking, through the official payment gateway (WeTravel), only the conditions stipulated in said section on the day of payment will be taken into account; any subsequent changes will not have retroactive effect on that reservation.
9.3 WHAT IS NOT INCLUDED? Visas, airline tickets and airport taxes, payment of customs duties, tolls, entry and exit fees, government authorizations, vaccination certificates, “extras” such as coffees, wines, spirits, mineral waters, special dietary regimes, laundry and ironing services, optional hotel services, and, in general, any other service not expressly listed in the aforementioned adventure trip section(s) or not specifically detailed in the program.
In the case of excursions not contracted with WANDERNOW S.A de C.V at the origin, it must be noted that they do not form part of the adventure trip contract and are governed by their own terms and conditions.
If the traveler contracts other visits, excursions, or any other activity at the destination, we inform you that we are not responsible for their information and execution, as they will not form part of the adventure trip contract.
Tips paid by the traveler at the destination for contracted services are not part of the adventure trip price.
10. Passports, Visas, and Documentation
10.1 All travelers, without exception (including minors), must carry their corresponding personal and family documentation in order, such as a passport, according to the laws of the country or countries to be visited. It will be their responsibility, when the adventure trips so require, to obtain visas, passports, vaccination certificates, etc.
10.2 Should a visa application be rejected by any Authority due to particular reasons of the traveler, or should entry to the country be denied due to lacking required documents, or due to a defect in the required documentation, or for not carrying it, WANDERNOW S.A de C.V disclaims all responsibility for such incidents, with any resulting expenses being borne by the traveler, and in these circumstances, the conditions and rules established for cases of voluntary withdrawal from services shall apply. All travelers, and especially those of non-Mexican nationality, are also reminded that they must ensure, before starting the adventure trip, that all applicable regulations and requirements regarding visas have been met in order to enter all countries to be visited without problems.
10.3 Minors under 18 years of age must carry written permission signed by their parents or guardians, in anticipation that it may be requested by any authority.
10.4 Regardless of the information provided, the traveler is informed that it is their responsibility to have, prior to the start of the adventure trip and with sufficient time, the documentation that allows them to visit the destination or transit locations.
10.5 Persons of non-Mexican nationality must consult their respective embassies or consulates for documentation requirements and other formalities they must complete to undertake the adventure trip.
10.6 The visa and entry requirement information displayed by Wandernow on its website, receipts, and application is for reference and may change without notice; the traveler must confirm it on the official websites of the destination country before traveling.
